For what purpose and on what legal basis does the National Association of Statutory Health Insurance Funds, DVKA, process your personal data?
The National Association of Statutory Health Insurance Funds, DVKA, is mandated amongst other things to establish the applicable insurance law for persons who live in Germany and are customarily employed in several Member States of the European Union. This requires the personal data to be processed which are needed to deal with applications to establish the applicable legal provisions. The legal basis for the processing of such data is constituted by sections 219a and 219b of Book V of the German Social Code (Sozialgesetzbuch V), in conjunction with Article 13 of Regulation (EC) No 883/2004 of the European Parliament and of the Council on the coordination of social security systems and Article 16 of Regulation (EC) No 987/2009 of the European Parliament and of the Council laying down the procedure for implementing Regulation (EC) No 883/2004.
Depending on the individual case, the National Association of Statutory Health Insurance Funds, DVKA, may also receive data from third parties (e.g. German and foreign social insurance institutions and other agencies) which are involved in the process, in connection with the establishment of the applicable legal provisions.
What personal data are processed by the National Association of Statutory Health Insurance Funds, DVKA?
The National Association of Statutory Health Insurance Funds, DVKA, processes the following personal data:
- individual data (e.g. first name and surname, date of birth, address),
- communication data (e.g. telephone number, e-mail address), and
- data on gainful employment (e.g. data on employers, employment periods, places of work).
To whom are your personal data provided?
The processing of an application for the establishment of the applicable legal provisions makes it necessary for the National Association of Statutory Health Insurance Funds, DVKA, to contact a variety of agencies in Germany and abroad. This involves transmitting personal data within the boundaries of the statutory provisions, as a rule to: applicants and their employers or authorised representatives, competent authorities or bodies of the Member States concerned designated by them, German social insurance agencies (health insurance funds, German Social Accident Insurance, German Federal Pension Insurance, the Artists’ Social Welfare Fund, Social Insurance for Agriculture, Forests and Gardening, the Federal Employment Agency and the Family Benefits Offices), the Association of Pension Schemes of the Liberal Professions, main customs offices, prosecution offices and courts. Personal data are furthermore only transmitted in individual cases as defined by law in accordance with sections 67d et seqq. of Book X of the Social Code (e.g. to police authorities, local and municipal administration, tax authorities).
The National Association of Statutory Health Insurance Funds, DVKA, uses the services of a communication service-provider, to answer telephone enquiries. This service-provider only collects, processes and uses personal data within the statutory and contractual boundaries.
Are your personal data transmitted to third countries?
If you also work in Switzerland, or if your employer is domiciled there or in another third country, the National Association of Statutory Health Insurance Funds, DVKA, will transfer your personal data to this country as part of the examination and establishment of which legal provisions are applicable to you. Personal data are transmitted to third countries on the basis of section 77 subsection (3) No. 2 of Book X of the Social Code.
For how long does the National Association of Statutory Health Insurance Funds, DVKA, store your personal data?
The National Association of Statutory Health Insurance Funds, DVKA, only stores your personal data as long as is necessary to carry out the purpose for which they were collected (conclusion of an exemption agreement), or as required by law. The standard set for defining the statutory retention periods includes section 110a of Book IV of the Social Code and section 84 of Book X of the Social Code.
